Terms and Conditions of Use

These Terms and Conditions govern the use of the application available at app.krakensteel.eu (“the application”), operated by Kraken Steel.

1. Acceptance of Terms

By accessing the application and logging in, the user declares that they have read, understood and fully accept these Terms and Conditions, as well as the Privacy Policy. If you do not agree with any provision, you must refrain from using the application.

3. Object of the Application

The application provides an automated quotation tool for laser cutting services for sheet metal. It allows the user to:

  • Upload vector files (DXF/SVG) with the geometry of the parts;
  • Select material, thickness, finish and quantity;
  • Obtain an automatically calculated quotation, with associated PDF;
  • Save, view and send quotations by email;
  • Manage their profile and billing data.

4. Registration and Access

  • Access to the application requires authentication via a Google account (OAuth 2.0).
  • The user is responsible for the security of their Google account and for all actions carried out through it in the application.
  • The application is intended for users aged 18 and over, with legal capacity to contract.
  • The user must provide true, accurate and up-to-date data in their profile fields.

5. Nature of Quotations

  • Quotations generated by the application are indicative and based exclusively on the parameters and files submitted by the user.
  • The quotation is valid for 30 days from the date of issue, unless otherwise indicated.
  • Prices shown do not include VAT at the applicable legal rate, which will be added on invoicing.
  • Kraken Steel reserves the right to review, adjust or refuse any quotation when, during technical verification of the file, any of the following are identified: errors, ambiguities or technical impossibilities in the geometry; specifications exceeding the capacity of the equipment; significant variations in raw material costs since the time of calculation.
  • The mere generation of a quotation does not constitute a binding contractual offer, nor does it create any obligation to perform on the part of Kraken Steel until express confirmation.

6. Order Confirmation and Payment

  • Production begins only after express confirmation from Kraken Steel, communicated to the client.
  • The payment terms applicable to the user (e.g. immediate payment, agreed credit terms) are set out in their profile and may be adjusted by bilateral agreement.
  • Kraken Steel may require full or partial advance payment, particularly for first orders or high-value orders.

7. Delivery and Collection

  • Delivery times are indicative and run from the confirmation of the order and, where applicable, from receipt of payment.
  • The method of receipt (collection at the registered office or delivery) will be agreed on a case-by-case basis.
  • Transport costs, where applicable, are the client’s responsibility, unless otherwise agreed.

8. User Responsibilities

The user undertakes to:

  • Ensure that they hold all intellectual property rights and other rights over the DXF/SVG files uploaded, assuming full responsibility for their lawful use;
  • Not use the application for unlawful, fraudulent, offensive purposes or in a manner that violates the rights of third parties;
  • Not attempt to circumvent the technical, security or capacity limits of the application;
  • Maintain the confidentiality of their Google account credentials.

9. Limitation of Liability

  • The application is provided “as is”. Kraken Steel uses its best efforts to ensure its continuous and correct operation, but does not guarantee the absence of errors, interruptions or unavailability.
  • Kraken Steel shall not be liable for: discrepancies between the indicative quotation generated by the application and the final price, resulting from technical file review or cost variations; temporary unavailability due to technical reasons, maintenance or force majeure; indirect losses, loss of profits or consequential damages arising from the use or inability to use the application; content or files uploaded by the user.
  • Nothing in these Terms excludes or limits Kraken Steel’s liability for fraud, gross negligence, or in circumstances which, under applicable law, cannot be excluded or limited.

10. Suspension and Termination

  • The user may cease use and delete their account at any time via the “Delete my account” button on the Profile page.
  • Kraken Steel reserves the right to suspend or terminate access for users who breach these Terms, with prior notice wherever possible.

11. Intellectual Property

  • The software, design, content, brand and logo “Kraken Steel” are the exclusive property of Kraken Steel or its licensors and are protected by applicable legislation.
  • DXF/SVG files uploaded by the user remain their property. The user grants Kraken Steel a non-exclusive licence, limited to fulfilling the purposes of the application (calculation, storage, production when contracted).
  • Copying, distribution, modification or unauthorised use of any protected element is prohibited.

12. Data Protection

The processing of personal data within the application is governed by the Privacy Policy, which forms an integral part of these Terms.

13. Modification of Terms

Kraken Steel reserves the right to amend these Terms at any time. Amendments take effect upon publication in the application; in the event of material changes, users will be notified. Continued use after changes implies acceptance of the updated Terms.

14. Governing Law and Jurisdiction

Portuguese law applies to these Terms. For the resolution of any disputes arising from their application or interpretation, the courts of the district of Kraken Steel’s registered office shall have jurisdiction, without prejudice to the right of consumers to resort to alternative dispute resolution entities under Law No. 144/2015.
